Frequently asked questions
Is overtime pay always 1.5 times my hourly rate?
Under the federal Fair Labor Standards Act (FLSA), yes — 1.5x for hours over 40 in a workweek. But some states add more: California requires daily overtime after 8 hours and double time after 12 hours.
Do I get holiday pay by law?
Federal law does not require private employers to pay extra for working on holidays. Holiday pay is a matter of company policy or union contract — our calculator shows what time-and-a-half would be if your employer offers it.
Is overtime really tax-free now?
No. The 2025 OBBBA law created a deduction (up to $12,500 single / $25,000 joint) on the half-time premium portion of overtime pay for 2025–2028 — not an exemption from tax. Our calculator explains the difference.
